Pretty surprising that even the 1st degree murder charge was dismissed and that 2nd degree is what he'll be charged for now. I mean, they got the wrong guy but whoever did it certainly planned it with intent to ~~murder~~ save lives of people needing medical insurance for their care.

I wonder why the prosecution felt like they couldn't get the 1st degree. Maybe 2nd degree is easier and has close enough sentencing that it isn't worth it to go with the harder to prove charge?
Given how many people rallied behind Mr. Magione when it happened, and how prevelant the "he needed killing" attitude still is in the US, they're probably thinking maybe they could avoid jury acquittal if they go for a lesser charge
The prosecution didn't back down, the judge dismissed the 1st degree charges. The judge ruled that this wasn't terrorism under New York law.
