Marvel can not use the character in any movie without Sony's approval. That also includes a potential appearance in a Spider-Man movie.

But Sony could always say "yes good idea lets do this!'

But that would mean for Sony to actually make a good or even a decent movie and they do not like that.

Nah, the Marvel Spiderman movies with Tom Holland could feature Kingpin if Sony allows that. No need for Sony to have creative control

Technically Spider-verse is Sony and those are excellent films.

However for live action I completely agree they are duds.

That is 100% correct, but don't let them know that. The Spiderverse movies are moving slowly into production hell already :(
