he has an active arrest warrent why isn't he being arrested the second he stepped foot on soil?

This is in New York. The US has never been part of the Rome Statute, which is the treaty that established the International Criminal Court.

Every American leader since Clinton has been too cowardly to commit to prosecuting war criminals. Maybe not too surprising since there's a strong argument to be made that they have all been war criminals themselves.

What's new with Trump is that he's actively attacking the ICC, but America has always been a safe haven for war criminals. "Nazi, Schmazi!" says Wernher von Braun.

That said, hasn't Mamdani promised to arrest Netanjahu if he wins the Mayoral race?

[–] RaoulDuke@piefed.blahaj.zone 6 points 3 days ago (3 children)

Does he really have that power?

[–] balsoft@lemmy.ml 10 points 3 days ago* (last edited 3 days ago)

No, bibi is rich and

okay

which means he will never get in any real trouble in the US

The rich will sooner personally shoot Mamdani on 5th avenue than allow this to happen

From a legal standpoint, the Rome statute only grants ICC jurisdiction in places that signed the statute, which New York does not have the power to do. The US constitution grants the president (with consent of senate) exclusive authority to enter into treaties.

Might as well find out

If he's within physical jurisdiction and Mamdani directs the NYPD to honor the ICC arrest warrant... I don't have the legal credentials to say whether or not that would fly

Interesting how that's where the UN is.

The institutions are scatterd around the world, but the general assembly is in the headquarters in NYC. I guess the idea was that it's the capital of the world or something.

isn't the un building "international soil" or something?

[–] Tenderizer78@lemmy.ml 1 points 3 days ago

It would require a constitutional amendment apparently, and that's not happening.

[–] TachyonTele@piefed.social 9 points 3 days ago

Because that stuff doesn't matter to someone at his level.

[–] Egonallanon@feddit.uk 7 points 3 days ago

The US is not a signatory to the rome statute and does not participate in the ICC so the warrant means nothing.

Arrest him, there's an ICC warrant out for him. Performative gestures don't have any impact in an uncivil setting.

Don't sit there and clap you dickheads, walk out with them.

[–] Hideakikarate@sh.itjust.works 10 points 3 days ago (2 children)

I wasn't sure if they were clapping for him or the people that walked out. If it was for him, you'd think they were meeting a celebrity or somethin. Just another thing in the really weird behavior pile. Treating politicians like celebrities or singers just doesn't make sense.

[–] cabbage@piefed.social 12 points 3 days ago

I'm pretty sure they are applauding the ones walking out. The decision to sit is not necessarily a message of support to Netanyahu, but a product of national policy. The Norwegian foreign minister was among the people who sat, in spite of being outspoken pro Palestine.

[–] slazer2au@lemmy.world 9 points 3 days ago

It could be regular conference etiquette. Every conference I have been to with speakers have as applause as the speaker takes the stage.

But I choose to believe they are congratulating those with a spine who walk out while a he talks.

Right? It's so frustrating that there's no media outlet containing a clear list. It's such an easy thing to do for journalists and they can't be arsed to do the basics of their job. All I could find out so far is that UK and US stayed
