Well it's only fair, he essentially handed in an empty paper. You get an F for that in school, too. Plus he very openly mocked them about it, too.

Okay, this is…. Funny, but it sounds like some of the money was meant to be used in the artwork (the commission was to recreate prior work that used money to represent incomes of people,)

The exhibition was meant to feature actual cash money, and the loan he is refusing to return was intended to be for that purpose.

It's not even payment that he's holding on to.
